Background The New Mexico Public Education Department (PED) is seeking legal representation in ongoing litigation related to Rule 6.10.5 NMAC, which pertains to school calendar requirements. The goal of this contract is to ensure that the PED has the necessary legal support while the litigation is pending. Work Details The contractor, Spencer Fane LLP, shall provide the following legal services: 1) Legal representation to the PED in current litigation concerning Rule 6.10.5 NMAC; 2) Ongoing legal services while the matter is pending in court; 3) Completion of briefing, argument, and research related to the case; 4) Consultation with the PED as a client during the provision of these legal services; 5) Performance of other directly related work as directed by the agency. Period of Performance The contract extension will be effective from April 25, 2026, to June 30, 2027. Place of Performance Legal services will be provided in Santa Fe, New Mexico. Bidder Requirements The prospective contractor must be Spencer Fane LLP, which serves as sole legal counsel for the PED in this complex matter. The agency has determined that no other businesses can perform this contract due to the unique qualifications and prior involvement of Spencer Fane LLP.
