Amendments to Zoning Ordinance for Vape/Smoke Shop Location Restrictions

A recent meeting document James City County - Agenda Packet - 2026-05-14 indicates a future potential acquisition James City County is considering amendments to the Zoning Ordinance to regulate the location of retail sales of tobacco and hemp products intended for smoking. The proposed changes would prohibit vape/smoke shops and vape/smoke lounges from being located within 1,000 linear feet of a child day center or a public, private, or parochial school, as defined by Virginia Code. The amendments would update use lists in multiple zoning districts (R-4, LB, B-1, M-1, PUD, MU, EO) to require a Special Use Permit (SUP) for vape/smoke shops and lounges, in accordance with the new section 24-41. Staff will finalize draft ordinance language for the June 3, 2026, Planning Commission meeting.
