Enforcement and Maintenance Contracting for RPD-I Buffer Zones

A recent meeting document Essex - Planning Commission Packet - 2026-05-14 indicates a future potential acquisition The Town of Essex is instituting new enforcement mechanisms for the maintenance of 50-foot buffer zones in the RPD-I District. If a property owner fails to maintain the buffer in accordance with an approved Reforestation Plan, the Town is authorized to contract for the required maintenance, replanting, or corrective work. All costs incurred, including administrative overhead, will be assessed against the property owner and may become a municipal lien. The Town will need to periodically contract with landscape maintenance firms, arborists, or environmental services providers to perform these corrective actions. There is also a requirement for periodic inspections (at least every ten years) by the Zoning Administrator or Town Tree Warden, which may create opportunities for third-party inspection or monitoring services.
