Background

Mortgage Servicing Solutions (MSS), a dba of Rhode Island Housing and Mortgage Finance Corporation, was founded in 2016 and is headquartered in Providence, Rhode Island. MSS acts as the mortgage loan sub-servicer for the Maine State Housing Authority (MSHA). The agency is inviting qualified firms to submit proposals for legal services specifically related to foreclosure and eviction in the State of Maine. This RFP aims to replace MSS's current legal counsel list; firms currently on that list must respond to this RFP if they wish to continue their engagement.

Work Details

The scope of services includes representation in foreclosure actions, which involves obtaining judgments, scheduling and attending foreclosure sales, providing written chronologies of matters, handling post-foreclosure sale closings including drafting and recording closing documents, disbursing sale proceeds, performing searches of PACER and SCRA databases, obtaining municipal lien certificates, conducting 50-year title searches to confirm MSHA's lien validity and priority, drafting pre-foreclosure sale notices in compliance with loan documents and applicable law, monitoring legislative changes, and preparing quitclaim deeds for FHA matters. For eviction matters, services include drafting and serving notices to quit, filing complaints along with appropriate pleadings and motions, obtaining post-judgment executions in coordination with sheriffs, scheduling hearings and eviction proceedings, and providing advice on legislative changes.

Period of Performance

The selected firm or firms will be engaged for a period ending on November 30, 2027.

Place of Performance

The legal services will be performed in the State of Maine.

Bidder Requirements

Firms must provide documentation regarding their professional liability insurance coverage of at least $5 million. They should also demonstrate experience with state departments or agencies in Maine over the past two years. Additionally, firms are encouraged to support diversity initiatives within their organizations.
