Background The U.S. Environmental Protection Agency (EPA) Region 5 is issuing this solicitation for Superfund Enforcement Action Management Support Services (SEAM). The goal of the contract is to provide comprehensive enforcement support for the Superfund Program, which requires effective integration of various activities and support services at designated Superfund sites. This includes addressing time-sensitive operations, notifications to Potential Responsible Parties (PRPs), public comment periods, and compliance with statutes of limitation. Work Details The contractor will be responsible for a range of enforcement activities and support services, including: 1. PRP Search Activities: Identification and investigation of all PRPs associated with Superfund sites. 2. General Enforcement Support: Providing strategic guidance and operational assistance to ensure compliance with environmental laws. 3. Negotiation Support: Facilitating negotiations with PRPs to reach settlements efficiently. 4. Litigation Support: Assisting in legal actions by preparing documents, gathering evidence, and providing expert testimony. 5. Cost Recovery Support: Analyzing costs incurred during site remediation and pursuing reimbursement from responsible parties. All analyses, recommendations, and reports must be submitted in draft form for review by the EPA Representative before distribution. Period of Performance The contract will be performed over a period from August 1, 2026, to July 31, 2029, with options for additional years. Place of Performance The work will primarily take place in Region 5 of the U.S., which includes states such as Illinois, Indiana, Michigan, Minnesota, Ohio, and Wisconsin. Bidder Requirements This opportunity is a Small Business Set Aside - Total (SBA). Bidders must demonstrate relevant experience in environmental enforcement support services and possess necessary staffing credentials and security clearances as required by the EPA. Incumbent Analysis (see Incumbents section for more detail) This opportunity appears to have a confirmed incumbent and/or closely related prior contract based on the 68HE0723D0002 award to Aleut Technical Services ($21,004,532, 04/28/23–05/15/27). That prior effort provided Superfund enforcement support that closely matches the SEAM scope, including PRP searches, pre-litigation and litigation support, negotiation support, cost recovery/financial analysis, and administrative records management (including processing and digitizing Superfund administrative records) along with FOIA and CERCLA lien-related support. The described work reads as a continuation of Superfund enforcement action management and related records/document support activities for EPA Superfund sites.
