Background

The State of Oregon, through the Department of Human Services (DHS), Aging and People with Disabilities (APD), Central Adult Protective Services Unit (APS), is issuing a Request for Application (RFA) for qualified Contract Attorneys to provide legal services in accordance with ORS 125 protective proceeding parameters for Adult Protective Services. This initiative aims to ensure that vulnerable adults receive necessary legal support in protective proceedings, such as guardianships and conservatorships.

Work Details

Contract Attorneys will perform all necessary work under Oregon statute and trial codes to prepare, file, and present petitions in protective proceedings under ORS chapter 125. This includes: 1. Drafting and filing petitions for individual guardianships or conservatorships. 2. Handling both temporary and permanent guardianship or conservatorship cases. 3. Managing contested hearings related to these proceedings. 4. Utilizing paralegals and office assistants when practical for tasks that do not require a practicing attorney's services. 5. Maintaining active membership in good standing with the Oregon State Bar throughout the contract duration.

Period of Performance

The initial term of the contract is anticipated to be five years, starting from the effective date specified in the contract agreement.

Place of Performance

Legal services will be provided within the State of Oregon, specifically serving clients referred by the APS unit.

Bidder Requirements

Applicants must be members of the Oregon State Bar in good standing with no disciplinary history in the past five years. They must reside and practice law within Oregon and demonstrate experience in protective proceedings such as guardianships or conservatorships.
